Terms of Service

1. Acceptance of Terms

By creating an account or using the Zerca mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years of age to use Zerca. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The App is initially available in Puerto Rico and the United States.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must provide accurate and truthful information in your profile
• You may not create multiple accounts or impersonate another person
• You are responsible for all activity that occurs under your account

4. Acceptable Use

Zerca is designed for organizing small, public meetups in safe locations. You agree to:

• Only create plans for public places (parks, restaurants, cafes, beaches, etc.)
• Not use the App for illegal activities of any kind
• Not harass, threaten, or discriminate against other users
• Not spam, create misleading plans, or abuse the platform
• Not use the App for commercial solicitation without authorization
• Respect the trust and safety systems (reputation, check-ins, trust levels)

5. Content & Conduct

You are solely responsible for the content you post, including plan descriptions, chat messages, and profile information. We reserve the right to remove content that violates these Terms or our Community Guidelines.

6. Trust & Safety Systems

Zerca uses trust levels, reputation scoring, and check-in verification to promote reliability and safety. You agree not to manipulate, game, or circumvent these systems. Attempts to artificially inflate reputation scores or trust levels may result in account suspension.

7. Liability Limitations

Zerca is a platform that facilitates connections between users. We do not organize, host, or supervise meetups. Zerca is not responsible for the actions, behavior, or conduct of any user, whether online or offline. You acknowledge that you participate in meetups at your own risk. To the maximum extent permitted by law, Zerca shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

8. Termination & Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, our Community Guidelines, or for any other reason at our sole discretion. Consequences may include:

• Visibility throttling (reduced reach of your plans)
• Temporary suspension
• Permanent account termination

9. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and the United States. Any disputes shall first be addressed through informal resolution by contacting legal@zerca.app.
